These Terms of Service govern your access to and use of the Vitakey website, online platform, account features, and related services (the "Services"). By visiting this website, creating an account, submitting a health intake, or purchasing a program, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.

1. Who we are

Vitakey is a telehealth platform owned and operated by Peptivo LLC ("Peptivo," "Vitakey," "we," "us," or "our"). Peptivo LLC provides the website, account tools, and administrative infrastructure that connect eligible visitors with independent, U.S.-licensed healthcare providers and independent, licensed pharmacies.

Peptivo LLC is not a medical practice, a physician, a pharmacy, or a dispensing facility. We don't diagnose conditions, prescribe medication, compound medication, or dispense prescriptions ourselves — those functions are carried out solely by the independent providers and pharmacies referenced throughout these Terms.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use the Services. Prescription-based programs are available only where the treating provider and dispensing pharmacy are authorized to operate, and availability may depend on your state of residence at the time of your evaluation.

3. Your account

When you register, complete an intake form, or contact our team, you agree to provide information that's true, current, and complete. You agree not to:

  • Create an account on someone else's behalf without proper authorization
  • Impersonate any person or misstate your identity, age, or location
  • Submit false or misleading health information
  • Share your login credentials or let another person use your account
  • Use your account to obtain treatment or medication intended for someone else

You're responsible for safeguarding your login credentials and for any activity that occurs through your account.

4. Website content isn't medical advice

Everything on this website — product descriptions, illustrative charts and calculators, blog-style content, FAQs, and marketing communications — is provided for general informational purposes only. None of it substitutes for individualized evaluation by a licensed medical provider, and none of it should be read as a promise of any particular outcome.

Do not start, stop, or change any treatment based solely on something you read on this website. Any illustrative timelines, projections, or calculators on the site are estimates based on typical protocol pacing, not predictions of your personal results.

5. Independent providers

All medical evaluations, diagnoses, and prescribing decisions are made exclusively by independent, U.S.-licensed healthcare providers. Each provider is solely responsible for reviewing your intake, ordering any laboratory work they deem necessary, determining whether treatment is appropriate, and setting the dosage and duration of any prescribed protocol.

Peptivo LLC doesn't influence or override a provider's clinical judgment. Any provider-patient relationship that forms exists between you and that provider — not between you and Peptivo LLC.

6. No guaranteed prescription

Completing an intake, submitting payment information, or requesting a specific product doesn't guarantee that a prescription will be issued. Every request is subject to:

  • Independent review by a licensed provider
  • Verification of your identity and location
  • The provider's clinical judgment
  • Applicable state and federal law
  • Acceptance and availability at the dispensing pharmacy

Your provider may decline to prescribe, request additional information or lab testing, recommend an alternative treatment, or discontinue a protocol at any time if they determine it's medically appropriate to do so.

7. Telehealth consent

Vitakey facilitates care delivered through online questionnaires, secure messaging, and, where applicable, live consultation — not an in-person examination. By using the Services, you acknowledge that telehealth has inherent limitations, and that your provider may determine an in-person visit, additional testing, or a specialist referral is necessary before or during treatment.

You agree to provide complete and accurate information about your medical history, current medications, allergies, pregnancy or breastfeeding status, and physical location whenever you interact with a provider through the platform.

8. Independent pharmacies

When a provider issues a prescription, it's routed to an independent, licensed pharmacy for fulfillment. That pharmacy — not Peptivo LLC — is responsible for accepting or rejecting the prescription, compounding or dispensing the medication, labeling and packaging it correctly, and shipping it to you.

We don't manufacture, compound, or dispense medication ourselves, and we can't guarantee pharmacy acceptance, processing time, or delivery dates.

9. Compounded medications

Depending on your provider's clinical judgment, your treatment may involve an FDA-approved medication or a compounded formulation prepared by a licensed compounding pharmacy.

Important: Compounded medications are not FDA-approved. The FDA doesn't review compounded formulations for safety, effectiveness, or quality before they reach a patient. Compounded products are typically used when a commercially manufactured medication doesn't meet a patient's specific clinical needs, as determined by their provider.

Formulation, dosage, concentration, and packaging can vary by prescription and by pharmacy. Always follow the specific instructions from your treating provider and dispensing pharmacy over any general information found on this site.

10. Medical emergencies

Vitakey isn't designed for urgent or emergency care and doesn't provide continuous medical monitoring. Don't use our website, messaging tools, or support inbox in a medical emergency.

If you're experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

11. Medication safety

Any medication carries the possibility of side effects, allergic reactions, or interactions with other substances. By accepting treatment, you agree to:

  • Take medication only as directed by your provider and pharmacy
  • Never share, sell, or transfer your medication to another person
  • Store medication safely and out of reach of children
  • Report side effects or changes in your health to your provider promptly
  • Seek emergency care right away for severe or concerning symptoms

Don't adjust your dose or combine treatments on your own without first speaking with your provider.

12. No guaranteed results

Individual results vary, and Vitakey doesn't promise any particular outcome, including but not limited to: approval for treatment, approval of a specific medication or dosage, a specific amount of weight loss or symptom improvement, medication availability, or how long any protocol will take to show results.

Any testimonials, projected timelines, or illustrative charts on this website reflect general or hypothetical scenarios and don't guarantee that you'll experience similar results.

13. Payment

Program pricing and what's included are shown before you check out. By submitting payment information, you confirm you're authorized to use that payment method, and you authorize us and our payment processor to charge the disclosed amount, including any applicable taxes and shipping fees.

You're only charged for a prescription-based product after a licensed provider has reviewed your intake and approved treatment. Our Services are self-pay; unless stated otherwise, we don't bill insurance, and we don't guarantee reimbursement through insurance, HSA, or FSA plans.

14. Refunds

Because clinical evaluations, prescriptions, and compounded or dispensed medications involve real costs the moment they're performed, fees tied to services already completed — including a completed provider evaluation, a prescription already sent to a pharmacy, or medication already compounded, dispensed, or shipped — are generally nonrefundable to the extent permitted by law.

If a specific offer states your payment is contingent on approval and your provider determines you're not eligible before a prescription is written, the refundable portion disclosed at checkout will be returned to your original payment method. Full details are in our Refund & Cancellation Policy. Nothing here limits any refund right you have under applicable law that can't be waived.

15. Subscriptions & cancellation

If you enroll in a recurring membership plan, the price, billing frequency, and cancellation process will be shown before you enroll, and by enrolling you authorize the recurring charges described until you cancel.

You can cancel anytime through your account dashboard or by contacting our care team. Cancelling stops future renewal charges once it's processed before your next billing date, but it doesn't refund a charge already processed, and it doesn't cancel a prescription that's already been sent to the pharmacy.

16. Shipping & delivery

Shipping timelines are estimates, not guarantees. You're responsible for providing an accurate delivery address, tracking your shipment, and receiving it promptly — particularly for temperature-sensitive medication.

Inspect your package as soon as it arrives. If it appears damaged, tampered with, mislabeled, or improperly stored in transit, don't use the medication — contact your dispensing pharmacy and our support team right away.

17. Electronic communications

By using the Services, you consent to receive account, appointment, payment, prescription, refill, safety, and shipping notices electronically. Marketing emails or texts require the separate consent you give when signing up, are never a condition of purchase, and you can unsubscribe at any time.

18. Privacy

Our collection, use, and disclosure of your personal and health information is described in our Privacy Policy. Independent providers and pharmacies you interact with may maintain their own separate privacy practices and notices regarding protected health information.

19. Acceptable use

You agree not to:

  • Use the Services unlawfully, deceptively, or fraudulently
  • Provide false information to obtain a prescription
  • Share, resell, or alter medication or its labeling
  • Access another person's account without authorization
  • Interfere with website security or introduce malware, bots, or other harmful code
  • Scrape or commercially exploit our content without permission
  • Harass our staff, providers, pharmacy personnel, or other users

We may suspend or terminate access for suspected fraud, safety concerns, nonpayment, or any violation of these Terms.

20. Intellectual property

The Vitakey website and everything on it — including our name, logo, design, illustrations, copy, and code — is owned by or licensed to Peptivo LLC and protected by applicable intellectual property laws. You may use the website only for your own personal, noncommercial purposes; nothing here transfers any ownership rights to you.

21. Third-party services

The Services may connect you with independent providers, pharmacies, laboratories, payment processors, and shipping carriers, each of which may operate under its own separate terms and privacy practices. Peptivo LLC isn't responsible for the independent medical, pharmacy, or business decisions made by those third parties.

22. Disclaimers

To the fullest extent the law allows, our non-clinical website and administrative Services are provided "as is" and "as available," without warranty of any kind. We don't guarantee that the website will always be available, uninterrupted, or error-free.

This section doesn't reduce the professional responsibilities of any licensed provider or pharmacy, or override any consumer protection you're entitled to under law.

23. Limitation of liability

To the fullest extent permitted by law, Peptivo LLC isn't liable for the independent clinical judgment, acts, or omissions of any provider or pharmacy referenced through the Services. We're also not responsible for shipping delays, carrier issues, medication shortages, inaccurate information you provide, medication misuse, or events outside our reasonable control.

To the fullest extent permitted by law, Peptivo LLC won't be liable for indirect, incidental, special, or consequential damages arising from your use of the non-clinical portions of our Services. Nothing in this section limits liability for our own fraud or willful misconduct, or any liability that can't legally be limited.

24. Disputes & governing law

If a dispute arises, you agree to first contact us and give us a reasonable opportunity to resolve it informally before filing a formal claim. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where federal law or a state's mandatory consumer protections apply.

Any arbitration agreement or class-action waiver separately presented and accepted during checkout applies according to its own terms, to the extent enforceable under applicable law.

25. Changes to these Terms

We may update these Terms as our Services, partners, or applicable laws change. When we do, we'll post the revised version here with an updated effective date, and we'll provide additional notice or seek renewed consent where the law requires it.

Note: These Terms work together with our Refund & Cancellation Policy and Privacy Policy. If anything in those policies conflicts with this document on refund or cancellation mechanics, the more specific policy controls.
